Federal high court refuse sacking Ben ayade over defection —JUSTNEWSNG

the governorship seat of Ben Ayade Citing the new judgment of the Court of Appeal on absconding, a Federal High Court in Abuja, on Thursday, would not declare vacant, the governorship seat of Ben Ayade over his defection from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC.

Justice Taiwo left from his previous judgment and clutched the choice of the Court of Appeal followed through on April 1, such that defection of a Governor and his Deputy isn’t an offense under the Nigerian Constitution until further notice.

The Judge held that governors and their delegates must be eliminated from office in accordance with segments 180, 188 and 189 of the Constitution which specified that they must be taken out from office because of death, resignation or prosecution.

Justice Taiwo expressed that since absconding isn’t one of the Constitutional arrangements, no court has ability to embed such into the Supreme Law. He, in any case, concurred that surrender from a winning party to a losing one is ill-advised.
